Holistic Trader Terms & Conditions

Holistic Trader is strictly a trade only website and we do not sell to the public. In order to purchase with us you must be purchasing stock to resell and not for your personal use. We welcome customers who sell online as well as in retail shops.

1. General
> 1.1 The Seller refers to Holistic Trader Ltd, a company registered in England and Wales (Company Registration No. 06460260, VAT Registration No. 797940167), located at Unit 3, Chestnut Drive, Wymondham Business Park, Wymondham, Norfolk, NR18 9SB.
> 1.2 The Buyer refers to the individual, company, or entity placing an order with Holistic Trader Ltd for the purchase of goods intended for resale and not for personal use.
> 1.3 No order will be deemed to constitute a contract of sale irrespective of the manner of its transmission to the Seller until the Goods are despatched by the Seller.

2. Minimum Order Value
> 2.1 The minimum order value is £140
> 2.2 The minimum order amount excludes carriage and VAT

3. Minimum Quantities
> 3.1 Customers must observe the minimum quantities required for specific items.
> 3.2 Any variations in minimum quantities will be specified for each product on the specific product page.

4. Pricing
> 4.1 All prices are listed in Pound Sterling (£) and are excluding VAT
> 4.2 All prices listed on the website are for one item unless otherwise stated.
> 4.3 The Seller reserves the right to amend or change any prices at any time without prior notice.
> 4.4 The price payable shall be the price displayed at the time of ordering, including any applicable discounts or promotions applied to the order. If no discounts or promotions are explicitly displayed or confirmed at the time of checkout, the standard listed price will apply.

5. Products
> 5.1 Products are subject to availability. If there is a product on your order which is out of stock the product will be removed from your order and you will be given a refund or credit on your account.
> 5.2 In the event of product discontinuation, Holistic Trader Ltd will notify the Buyer and offer either a suitable alternative product or a refund, based on the Buyer’s preference and product availability.

6. Delivery
> 6.1 The Seller shall not be held liable for any losses, expenses or consequential loss incurred by the Buyer or any other person or company however arising whether directly or indirectly out of a failure to meet an estimated delivery date.
> 6.2 Specific delivery requirements should be requested at the time of ordering
> 6.3 The minimum spend of £300+ (excluding VAT) qualifies for free UK carriage.
> 6.4 Carriage will be automatically calculated at the checkout
> 6.5 Orders placed by customers outside the United Kingdom may be subject to additional taxes, customs duties, and import fees as determined by the destination country. These charges are the responsibility of the Buyer and are not included in the purchase price or shipping fees.
> 6.6 The Seller will provide all necessary documentation for customs clearance but is not responsible for delays, additional fees, or confiscation due to the importing country's regulations.
> 6.7 International orders must be paid in Pound Sterling (GBP). The Buyer is responsible for all currency conversion fees or associated charges.
> 6.8 The Buyer is responsible for providing accurate and complete shipping information at the time of ordering. The Seller shall not be liable for delays, additional costs, or failed deliveries caused by incorrect or incomplete details supplied by the Buyer. The Buyer will be informed of any subsequent address-related delivery failures via email, or phone.
> 6.9 For international deliveries, the Buyer is solely responsible for paying any customs duties, taxes, or fees required by the destination country. The Seller will provide the necessary documentation but cannot guarantee customs clearance or account for delays caused by customs processing.

7. Payment Terms
> 7.1 Payments must be made prior to shipment, or at the point of sale
> 7.2 Accepted payment methods on our website include all major credit and debit cards, PayPal, Google Pay or Apple Pay. Bank Transfer is available upon request.
> 7.3 We do not accept cheque payments, or cash.
> 7.4 If any payment or part thereof is not received by the Seller by the due date, the Seller shall be entitled to charge interest on the outstanding amount at the rate of 2% per calendar month.
> 7.5 All goods remain the property of the Seller until fully paid for.
> 7.6 In the event of non-payment, the Seller reserves the right to reclaim the goods.
> 7.7 All payments must be made in Pound Sterling (GBP). For international transactions, the Buyer is responsible for any additional costs associated with currency conversion, including fees imposed by their bank or payment provider.
> 7.8 Invoices are provided electronically upon payment, and can also be found in the Buyer’s online account. These are available upon request by contacting admin@holistictrader.co.uk

8. Holding Orders
> 8.1 Unpaid orders, such as those requiring bank transfer payment must be made within one week of receiving an order acknowledgement.
> 8.2 Orders that remain unpaid will be held for a maximum of one month.
> 8.3 After one month of non-payment, orders will be cancelled, and items will be returned to stock.

9. Claims, Damages and Returns
> 9.1 Notification of damage of wrongly shipped goods or incompletely shipped goods must be made within 14 days of delivery. Any claim made outside of 14 days will not be accepted. Notification of damage or claims must be made via admin@holistictrader.co.uk
> 9.2 Proof of any fault or damage is required, including photographic evidence, which must be submitted at the time of the claim.
> 9.3 The Buyer will be liable for the cost of remedying damage to returned goods where such damage has in the opinion of the Seller been caused by the goods being inadequately packaged by the Buyer.
> 9.4 The Seller does not accept returns of damaged items, unless specifically requested.
> 9.5 If an item is not faulty but is returned because it does not meet the Buyer’s preference, the Buyer may return it at their own expense, provided the item is in a resellable condition
> 9.6 Returned items must be securely packed to prevent damage during transit.
> 9.7 The Seller's failure to insist upon strict adherence to any of the terms and conditions with this contract shall not be deemed a waiver of its rights within these terms and conditions.
> 9.8 The Seller reserves the right to refuse the return of goods that are returned damaged, incomplete, or in an unsaleable condition due to causes not attributable to the Seller.
> 9.9 If such returns are accepted, the Buyer will be notified, and either a restocking fee or partial credit may be applied. The Seller reserves the right to determine these amounts based on the condition of the returned goods.
> 9.10 In cases where such goods are accepted, the Buyer may be liable for costs to repair or restore the items to a sellable condition, or the Seller may offer partial credit at its discretion.
> 9.11 Goods returned without adequate packaging, leading to further damage during transit, may be declined or credited at a reduced value.

10. Loss in Transit
> 10.1 Customers should notify the Seller immediately and within 5 working days if parcels arrive damaged or with missing items.
> 10.2 All packaging should be retained to facilitate inspection by relevant authorities.
> 10.3 The Buyer will be offered a refund, or credit on account for items deemed to be lost in transit once a full investigation by the courier, and the Seller has taken place.

11. Special Orders
> 11.1 Goods that are custom-ordered or specifically designed for a customer are subject to a mutual, binding agreement.
> 11.2 Special orders are considered contracts to supply and may not be canceled without prior agreement.

12. General Provisions
> 12.1 All company publications are copyrighted and may not be reproduced without permission.
> 12.2 All content on the Seller website, including but not limited to text, images, graphics, logos, trademarks, icons, videos, and digital downloads, is the intellectual property of the Seller or its content providers. This content is protected under UK and international copyright, trademark, and other intellectual property laws.
> 12.3 The reproduction, distribution, modification, or use of any content from the website without prior written consent from the Seller is strictly prohibited. This includes, but is not limited to, the use of company trademarks or logos for any purpose not expressly authorized.
> 12.4 Any unauthorized use of the Seller’s intellectual property may result in legal action. For permission requests, please contact us directly at admin@holistictrader.co.uk
> 12.5 The Seller reserves the right to cancel any quotation without notice.
> 12.6 The Seller shall not be held responsible for failure to perform its obligations under these Terms and Conditions due to circumstances beyond its reasonable control.
> 12.7 Such circumstances include, but are not limited to, acts of God, natural disasters, pandemics, war, terrorism, government restrictions, industrial disputes, shortages of materials, supply chain disruptions, power failures, or other unforeseen events.
> 12.8 In the event of a force majeure, The Seller will notify the Buyer as soon as reasonably possible. The Seller will make every effort to resume fulfillment of obligations once the situation is resolved.
> 12.9 The Seller accepts no responsibility for latent defects in standard items offered for sale.

13. Legal Liability
> 13.1 The contracts from the sales of goods by Holistictrader.co.uk shall be subject to and governed by English law.
> 13.2 The Seller shall not be liable for indirect, incidental, or consequential damages arising from the use of its products, delay in delivery, or other performance issues, except as required by law. The maximum liability of the Seller shall not exceed the total purchase price of the goods in question.
> 13.3 While the Seller endeavors to ensure all product information and pricing is accurate, errors or omissions may occur. If errors are identified, the Seller will notify the Buyer before dispatch to confirm adjustments or cancellations. E.g. If an item is listed at £10 but the correct price is £15, the Seller will notify the Buyer prior to dispatch to confirm the updated pricing or cancellation.
> 13.4 The Seller cannot accept liability for injury or damages arising from the improper use or handling of products sold by the Buyer.
> 13.5 In the event of a dispute arising from these Terms and Conditions, the Buyer and Seller agree to attempt to resolve the matter through good faith negotiations.

14. Product Photography Disclaimer
> 14.1 The photographs displayed on our website are intended to provide an accurate representation of the products offered by the Seller.
> 14.2 Due to the natural origin of some items such as crystals and natural specimens, each piece is unique, and individual specimens may differ in colour, shape, size, and pattern from the images shown.
> 14.3 Our products vary by batch, with differences in texture, inclusions, and other natural characteristics.
> 14.4 While we aim for consistency, these natural variations are inherent and contribute to the unique qualities of each piece.
> 14.5 We make every effort to keep product images current and reflective of new batches as they arrive. However, updates may not always reflect changes immediately, and images may not capture every natural variation.
> 14.6 The colours in product photographs are intended to be as accurate as possible; however, they may appear slightly different in person due to screen settings, lighting conditions, and photographic techniques. Although we work to minimize discrepancies, exact colour matches cannot be guaranteed.
> 14.7 By purchasing, customers acknowledge and accept that natural variations in appearance are to be expected and that products received may not exactly match the website images. The Seller is not liable for minor visual differences between the actual items and their photographic representations on the website.

15. Acceptance of Terms
> 15.1 By placing an order with the Seller you are agreeing to be bound by our terms and conditions. This does not affect your statutory rights as a customer.
> 15.2 The Seller reserves the right to update these Terms and Conditions at any time. Updates will take effect immediately upon publication on the Seller’s website unless otherwise stated. It is the Buyer’s responsibility to review the Terms and Conditions regularly to stay informed of any changes. For significant updates that may affect the Buyer’s rights or obligations, the Seller will provide notice via email or other appropriate communication channels. By completing a purchase, the Buyer acknowledges and agrees to the most current version of the Terms and Conditions.
> 15.3 It is the responsibility of the Buyer to review the Terms and Conditions regularly. By continuing to use our services after amendments are published, the Buyer agrees to be bound by the revised Terms and Conditions.

> 16.1 Customers should refer to our Private Policy available in our FAQs, for the details on the collection, storage, and sharing of information.
> 16.2 By placing an order, customers agree to the terms of our Privacy Policy.
